Certificate of Need for Alcohol

Certificates of Need for Alcohol are regulated under the Decree 599/987, which establishes regulations for fixing sale prices of alcohol used to elaborate products intended for export.

The procedure implies that ANCAP shall sell, on presentation of the Certificate of Need issued by LATU, certain alcohols at the importation price, provided that they are used to manufacture products intended for export.

Drawback


The Drawback procedure involves the partial or total refund of duties and taxes that would have been paid for the importation of goods used in the improvement, complementing, assembly or fitting-out of other final merchandise exported.

Decree 431/997 (November 6th, 1997) facilitates its access, putting it on an equal position with the existing regulations for the Temporary Admission Regime.

In short, this procedure implements the restitution of taxes and duties paid for the importation of inputs included in the production of exported goods.

Import of Refined Sugar for Industrial Use


At the end of the year 2000, the Executive Power created this regime aimed at protecting sugar processing companies in our country and improving the competitiveness of the sector that uses refined sugar as an input for the industrial process, which shall benefit consumers, achieving an effective reduction in the sale price of the final product.

This regime exempts imports of refined sugar made by companies that use sugar with an industrial purpose from duties.


Regulatory framework

Article 2 - Decree 57/006, dated March 1st, 2006, exempts refined sugar imports made by companies that use sugar with an industrial purpose from duties, after receiving the authorization of the Ministry of Industry, Energy and Mining.

The Ministry of Industry, Energy and Mining establishes the administrative mechanisms under which refined sugar imports for industrial use shall operate and entrusts the Technological Laboratory of Uruguay (LATU) to control the regime.

LATU External Circular 524/006 establishes the requirements for the procedure to get the Refined Sugar Importation License (LIAR) with an industrial purpose.

LATU External Circular 524/006 states the process and the information companies shall have to present in order to justify the industrial use of imported sugar under Decree 57/006.
Requirements to operate under this regime

Companies that intend to operate under this regime shall have to register the company and have the authorization of their plant. Those companies that are already registered in LATU and are authorized to operate under any other special regime under LATU’s control shall be exempted from these requirements, provided the plant has been authorized in the same activity branch.

To be able to apply for the Refined Sugar Importation License (LIAR) to the National Directorate of Industry, companies must have the registration certificate issued by LATU. For such purposes, they have to request the registration certificate in headed paper from the company with the following information: a) registered name of the industrial company and taxpayer registration number, b) customs code, c) physical volume to be imported, and d) detail of products to be manufactured.


Statement of sugar consumption

Companies under the regime must present a statement indicating the consumption including the decrease of refined sugar per unit of final product to be manufactured. Consumptions shall be studied by LATU technicians who may visit the company to verify what has been stated or perform analyses of sucrose to determine the consumption.


Justification of the industrial use of sugar

In order to justify the industrial use of sugar, companies must present a sworn statement indicating the amount of sugar acquired under the regime and the amount of manufactured and produced product for a specific period.

LATU External Circular 505 states the process and the information companies shall have to present in order to justify the industrial use of imported sugar under Decree 57/006.
